In a published opinion, the U.S. Court of Appeals for the Fourth Circuit affirmed the district court’s granting of summary judgment in favor of a correctional healthcare provider defended by Chris Dadak and Susan Waddell. An inmate sued the doctor claiming deliberate indifference to his serious medical need: diabetes. The Honorable Michael F. Urbanski of the Western District of Virginia granted summary judgment in favor of the doctor on all counts. The plaintiff inmate appealed to the Fourth Circuit. Chris Dadak briefed and argued the case on appeal.
This opinion not only affirmed important analysis from the district court but provided analysis for future cases defending medical professionals in deliberate indifference claims. The Court held: “[A] disagreement among reasonable medical professionals is not sufficient to sustain a deliberate indifference claim.”
